Terms of website use
This terms of use (together with the documents referred to in it) tells you the terms of use on which you may make use of our website https://basildonportal.morgansindall.com/ (The Basildon Portal), as a registered user. You are either a client of ours or a tenant user who has been expressly authorized to use the Basildon Portal by a client of ours. No other persons are permitted to access and/or use the Basildon Portal.
Please read these terms of use carefully before you use the Basildon Portal, as these will apply to your use of the Basildon Portal. We recommend that you print a copy of these terms and conditions for future reference.
By using the Basildon Portal, you confirm that you accept these terms of use and that you agree to comply with them.
If you do not agree to these terms of use, you must not use the Basildon Portal.
Other applicable terms
These terms of use refer to the following additional terms, which also apply to your use of the Basildon Portal:
Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using The Basildon Portal, you consent to such processing and you warrant that all data provided by you is accurate.
Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of The Basildon Portal. When using The Basildon Portal, you must comply with this Acceptable Use Policy.
https://The Basildon Portal.co.uk/ is a site operated by Morgan Sindall Property Services Limited, (we or us). We are a limited company registered in England and Wales under company number 04415196 and have our registered office at Kent House, 14 – 17 Market Place, London, W1W 8AJ. Our VAT number is [ 04415196].
We are members of The Property Ombudsman (TPO) scheme and the recognised trade body The Association of Residential Managing Agents (ARMA).
The Basildon Portal is a website to which access is granted on a discretionary basis and which allows our clients and their tenants to report any issues with their properties directly to our property management team online. Our clients and their tenants are also able to use other communication methods to report issues to us, such as by phone, by email and by post.
Different access levels to the Basildon Portal are granted to our clients and their authorised tenant users. For example, our clients may be able to use the Basildon Portal for accessing certain block account and other financial information.
We may revise these terms of use at any time by amending this page.
If we do make any changes we will notify you of those changes. Any changes we make are binding on you. If you do not wish to accept any changes made, you must no longer use the Basildon Portal. You
We may update the Basildon Portal from time to time and may change the content at any time. However, please note that any of the content on the Basildon Portal may be out of date at any given time.
We do not guarantee that the Basildon Portal, or any content on it, will be free from errors or omissions.
The Basildon Portal is made available to our clients and their authorised users on a discretionary basis and free of charge.
Our clients are responsible for ensuring that all of their authorised users who access the Basildon Portal are aware of, and accept, these terms of use and other applicable terms and conditions, and that they comply with them.
If access is withheld from a client then access will also be withheld from that client's authorised tenant users (authorised tenant users' access is entirely conditional and dependent on the respective client's permitted access).
We do not guarantee that the Basildon Portal, or any content on it, will always be available or be uninterrupted. Access to The Basildon Portal is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Basildon Portal without notice. We will not be liable to you if for any reason the Basildon Portal is unavailable at any time or for any period. Our clients and their tenants are able to use other communication methods to report issues to us, such as by phone, by email and by post.
You are responsible for making all arrangements necessary for you to have access to the Basildon Portal.
You will be provided with a user name and password as part of our security procedures, and you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user name or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
If you know or suspect that anyone other than you knows your user name or password, you must promptly notify us at Basildon.Repairs@morgansindall.com
We are the owner or the licensee of all intellectual property rights in the Basildon Portal, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You must not use the Basildon Portal, including any part of the content on the Basildon Portal, for any purpose other than for the purpose of the management of your property. The Basildon Portal is a communication tool between us and you, developed for this limited purpose only.
If you print off, copy or download any part of the Basildon Portal in breach of these terms of use, your right to use the Basildon Portal will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
Although we make reasonable efforts to update the information on the Basildon Portal, we make no representations, warranties or guarantees, whether express or implied, that the content on the Basildon Portal is accurate, complete or up-to-date.
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Basildon Portal or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
use of, or inability to use, the Basildon Portal; or
use of or reliance on any content displayed on the Basildon Portal.
If you are a client of ours and, therefore, a business user, please note that in particular, we will not be liable for:
loss of profits, sales, business, or revenue; business interruption;
loss of anticipated savings;
loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
If you are a client of ours, please note that you are also subject to the terms and conditions of the agreement between us, including, in particular, the limitation of our liability set out therein, if any.
If you are an authorised tenant user, please note that we only provide the Basildon Portal to you for your own domestic and private use, as a tenant of our client's property. You agree not to use the Basildon Portal for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Basildon Portal or to your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on the Basildon Portal. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
Whenever you make use of a feature that allows you to upload content to The Basildon Portal, or to make contact with other users of The Basildon Portal, you must comply with the content standards set out in our Acceptable Use Policy.
You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are an authorised tenant user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
Any content you upload to The Basildon Portal will be considered non-confidential and non-proprietary. We cannot guarantee any confidentiality in any content you upload to The Basildon Portal. You retain all of your ownership rights in your content, but you are required to grant us and other users of The Basildon Portal, so far as they are permitted to access such content, a limited license to use, store and copy that content and to distribute and make it available to third parties. For example, if you upload a photo which shows damage to your property, we may share that photo with an external third-party contractor whom we may engage to repair the damage. The rights you license to us are described in the next paragraph (Rights you license).
We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Basildon Portal constitutes a violation of their intellectual property rights, or of their right to privacy.
We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of The Basildon Portal.
You are solely responsible for securing and backing up your content.

This notice is provided to explain the basis on which any personal information we collect from you, or which you provide to us, is processed.
Morgan Sindall Property Services Limited is committed to protecting and respecting your privacy in accordance with its privacy policy.
We do not ask that you provide any sensitive personal data. This is data revealing information about an individual’s racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade-union membership, and includes genetic data, biometric data (for the purpose of uniquely identifying an individual), data concerning health, or data concerning a natural person’s sex life or sexual orientation. If you do provide it, this will be an indication that you explicitly consent to us processing this information.
When you upload or post content to the Basildon Portal, you grant the following licenses:
We do not guarantee that the Basildon Portal will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform in order to access the Basildon Portal. You should use your own virus protection software.
You must not misuse the Basildon Portal by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Basildon Portal, the server on which the Basildon Portal is stored or any server, computer or database connected to the Basildon Portal. You must not attack the Basildon Portal via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Basildon Portal will cease immediately.
Our clients may link to the Basildon Portal home page for the purposes of use of the Basildon Portal by your authorised users, provided you do so in a
way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to the Basildon Portal in any website that you do not own.
The Basildon Portal must not be framed on any other site, nor may you create a link to any part of the Basildon Portal other than the home page. We reserve the right to withdraw linking permission without notice. The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

Where the Basildon Portal contains links to other sites and resources provided by third parties, these links are provided for your information only.
We have no control over the contents of those sites or resources.
If you are an authorised tenant user, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction.
If you are a client of ours, these terms of use, its subject matter and its formation (and any non- contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
